Liability Waiver & Assumption of Risk

I understand and agree that the Mariposa Butterfly Festival, County of Mariposa, Mariposa County Fairgrounds, and all associated board members, employees, volunteers, contractors, representatives, heirs, trusts, successors, and assigns (collectively, the “Released Parties”) are not responsible for my personal safety or the safety of my property at any time before, during, or after the event.

I voluntarily assume all risks of personal injury, death, property damage, property loss, theft, or any other harm arising from or related to my participation in the event, whether caused by negligence or otherwise.

I waive, release, and discharge all claims of every kind against the Released Parties.

Indemnification Agreement

I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, liabilities, demands, damages, losses, expenses, and costs (including legal and attorney fees) arising from or in any way related to my participation in the event.

This includes, but is not limited to, claims arising from my booth, products, food, merchandise, services, equipment, signage, or any actions or omissions by myself, my employees, agents, contractors, customers, or guests.

Acts of God, Emergencies, Violence, or Terrorism

I understand and agree that the Released Parties are not responsible for any inability to operate the event, delays, loss, evacuation, or changes caused by circumstances beyond their control.

These circumstances include, but are not limited to, acts of God, natural disasters, dangerous or severe weather, fire, flooding, power outages, government orders or shutdowns, public health emergencies, terrorism, threats of terrorism, violent acts, active shooter situations, civil unrest, riots, disturbances, venue closures, or mandatory safety evacuations.

I acknowledge that no refunds, credits, transfers, or compensation will be provided under these circumstances and I waive all related claims.

No Refund, No Credit, No Chargeback Policy

I understand and agree that all vendor fees are final and non-refundable without exception. This includes cancellations or inability to attend due to illness, travel issues, emergencies, dissatisfaction with sales or attendance, business changes, weather conditions, or any personal or logistical circumstances.

I agree not to initiate a chargeback or payment dispute for any reason and acknowledge that vendor fees cover administrative, marketing, and operational expenses incurred upon registration.

Vendor Responsibilities & Compliance

I agree to operate my booth in a safe, professional, and lawful manner at all times. I am responsible for complying with all local, county, and state regulations, including but not limited to health permits, food handling requirements, fire safety, and sales tax obligations.

I understand that all booths must remain open during official event hours and that early breakdown is not permitted without prior approval. I agree to maintain my space in a clean and orderly condition and to remove all trash and materials at the conclusion of the event.

Responsibility to Check the Event Website for Updates

I understand that technology can fail, emails may not be delivered, and messages may be filtered or blocked if I unsubscribe. I agree that it is my responsibility to check the official event website prior to attending for the most current information regarding event date and time, load-in instructions, parking, booth placement, maps, updates, and any schedule or logistical changes.

I waive all claims of non-notification and agree that the website serves as the final and authoritative source for event updates.

Agreement and Legal Acceptance

By completing my registration, I confirm that I have read, understand, and agree to all Vendor Terms & Conditions stated above. I understand that this agreement is legally binding and applies to me, my business, and any employees, agents, contractors, or representatives associated with my participation in the Mariposa Butterfly Festival and any related or co-produced events.
